Termites and the Alabama Wood Infestation Report (WIR)

Within the Alabama Residential Purchase Agreement, there is a contingency regarding termites.

In Alabama, termite and wood infestation protection is an important part of the home buying process, especially for new construction homes. According to the termite contingency in the contract, the buyer is responsible for obtaining a Wood Infestation Report (WIR) from a licensed pest control company, unless the type of loan requires the seller to pay for it. The WIR covers visible infestations and damage from termites and other wood-destroying organisms. If active infestations are found, treatment is required at the seller’s expense. If any past damage is detected, the buyer can order a structural inspection at their own cost to assess the extent of repairs needed. If the results are unsatisfactory to the buyer, the contingency allows for negotiation or the possibility of terminating the contract.

In Alabama, if the lender does not require a Wood Infestation Report (WIR), it is up to the buyer whether they want to have the report done. The cost of a WIR is typically around $150. If you are financing and do not plan to obtain a WIR, the lender will not want it referenced in the purchase agreement. If the contract currently states the buyer has a WIR contingency, and the buyer chooses not to proceed, this contingency should be removed from the contract.
